Non-Court Dispute Resolution

Arbitration is a form of alternative dispute resolution (ADR) in which the parties to a dispute agree to have a neutral third party, called an arbitrator, decide the case. The arbitrator’s decision is binding on the parties, and it is usually final and cannot be appealed.

Alternative dispute resolution (ADR) is a broad term that refers to any process that allows parties to resolve their disputes without going to court. ADR methods typically involve a neutral third party who helps the parties reach an agreement.

There are many different types of ADR methods, including:

  • Mediation: A neutral third party, called a mediator, helps the parties to communicate and negotiate a resolution to their dispute. The mediator does not make a decision for the parties, but they can help them to reach an agreement that is mutually acceptable.
  • Arbitration: A neutral third party, called an arbitrator, hears the evidence and arguments from the parties and then makes a binding decision on the case.
  • Negotiation: The parties to a dispute directly negotiate with each other to reach an agreement.
  • Early neutral evaluation: A neutral third party, called an evaluator, reviews the case and provides the parties with an assessment of the strengths and weaknesses of their respective positions. This can help the parties to reach an agreement or to decide whether to proceed with litigation.

ADR methods can offer a number of advantages over traditional litigation, including:

  • Speed: ADR methods can often be faster than litigation, as they do not require the same amount of court time and paperwork.
  • Cost: ADR methods can often be less expensive than litigation, as they do not require the same level of legal representation.
  • Privacy: ADR methods are often more private than litigation, as the proceedings are not usually open to the public.
  • Flexibility: ADR methods can be more flexible than litigation, as the parties can often agree on the specific procedures that will be used.

If you are involved in a dispute, you may want to consider using an ADR method to resolve it. ADR methods can offer a number of advantages over traditional litigation, and they can help you to reach a resolution that is mutually acceptable.
